Live Streaming Service Terms
1. General Provisions
1.1 These “Live Streaming Service Terms” (hereinafter referred to as “these Terms”) are intended to regulate your (hereinafter referred to as the “User” or “Streamer”) use of the internet live streaming and related technical services provided by us (hereinafter referred to as the “Platform”).
1.2 Before using the Platform’s live streaming services, Users must carefully read and fully understand the entire content of these Terms. Your commencement of using the live streaming services shall be deemed that you have read, understood, and agreed to be bound by these Terms and related platform rules (including but not limited to the User Agreement and Privacy Policy).
1.3 The Platform reserves the right to amend these Terms from time to time based on changes in laws and regulations or operational needs. The amended Terms will take effect after being published on the relevant page(s). If you do not agree to the amendments, you should immediately cease using the live streaming services; continued use shall be deemed as acceptance of the amendments.
2. Account and Qualifications
2.1 Users must use a Platform-authenticated account to conduct live streams and guarantee the truthfulness, legality, and accuracy of the registration information. Accounts may not be lent, transferred, or shared in any way.
2.2 Streamers must be at least 18 years old and possess full civil capacity to conduct live streaming activities. If the Streamer is an institution, it shall guarantee that it has obtained all necessary legal authorizations to engage in live streaming activities.
2.3 The Streamer undertake that their live streaming content and conduct comply with the laws and regulations of their location and the regions where the content is disseminated, and they shall independently bear legal responsibility for all activities under their account.
3. Streamer Code of Conduct
3.1 Streamers must strictly comply with laws, regulations, public order, and good morals during live streams, and undertakes not to produce, reproduce, publish, or disseminate information containing the following content:
(a) Opposing the fundamental principles established by the Constitution;
(b) Endangering national security, divulging state secrets, subverting state power, or undermining national unity;
(c) Damaging national honor and interests;
(d) Inciting ethnic hatred, ethnic discrimination, or undermining national unity;
(e) Undermining state religious policies, promoting cults or feudal superstitions;
(f) Spreading rumors, disturbing social order, or undermining social stability;
(g) Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crime;
(h) Insulting or slandering others, infringing upon the legitimate rights and interests of others such as reputation, privacy, intellectual property, or trade secrets;
(i) Containing other content prohibited by laws and administrative regulations.
3.2 Streamers shall interact civilly and express themselves rationally during live streams, and shall not organize or incite users to engage in activities that disrupt platform order, such as spamming, defamation, or personal attacks.
3.3 Live streaming content shall not involve the unauthorized streaming of film, television, music, games, or other content, and shall not infringe upon any third party’s legitimate rights and interests.
4. Intellectual Property
4.1 Intellectual property rights related to the live streaming technical services provided by the Platform (including software, interfaces, designs, data, etc.) are owned by the Platform.
4.2 The intellectual property rights to original audio-visual content created by the Streamer during live streaming (“Streamer Original Content”) belong to the Streamer. However, the Streamer understands and agrees to grant the Platform a worldwide, royalty-free, non-exclusive, sub-licensable license to use the Streamer Original Content (including but not limited to reproduction, caching, communication to the public via information networks, clipping, production of promotional materials, etc.) for the purposes of providing, promoting, and optimizing the services.
4.3 Virtual items generated through user consumption behaviors such as tipping or purchasing virtual gifts are owned by the Platform. Users/Streamers obtain the right to use them. Related services are non-refundable and cannot be exchanged for cash.
5. Revenue and Settlement
5.1 The specific settlement rules,ratio, cycle, and withdrawal methods for revenue earned by Streamers through live streaming (such as virtual gift sharing, event rewards, etc.) shall be subject to the rules published by the Platform in the Streamer backend.
5.2 The Platform reserves the right to adjust the revenue rules based on operational circumstances and will provide advance notice. Revenue earned by Streamers is subject to taxation according to law. The Platform will fulfill withholding and remittance obligations as applicable under laws and regulations.
6. Disclaimer
6.1 Users understand and agree that their live streaming content and interactive conduct represent their personal views. The Platform is not responsible for the truthfulness, accuracy, or legality of such content.
6.2 The Platform shall not be liable for service interruptions, data loss, etc., caused by force majeure (e.g., network or system failure), third-party service issues, or reasons attributable to the user, but will endeavor to minimize losses and impacts resulting therefrom.
6.3 The Platform does not guarantee that the services will meet all requirements or that the services will be uninterrupted. No guarantee is made regarding the timeliness, security, or accuracy of the services.
7. Violation Handling
7.1 If the Platform discovers or receives reports that a Streamer has violated these Terms, it has the right to take one or more of the following measures at any time without prior notice:
(a) Delete or block violating content;
(b) Interrupt or stop the live stream;
(c) Restrict account functions (e.g.,mute, banning live streaming permissions);
(d) Freeze or deduct revenue obtained from violations;
(e) Terminate the account and impose a permanent ban.
7.2 If the Streamer’s actions cause losses to the Platform or any third party, the Streamer shall bear full liability for compensation.
8. Termination of Terms
Users may terminate these Terms at any time by ceasing to use the live streaming services. The Platform also has the right to terminate the provision of all or part of the live streaming services to a User at any time based on its own business arrangements or User violations.
9. Miscellaneous
9.1 The interpretation, validity, and dispute resolution of these Terms shall be governed by the laws of the mainland of the People’s Republic of China.
9.2 Any dispute arising from these Terms shall be resolved by the parties through friendly negotiation. If negotiation fails, either party has the right to submit the dispute to the competent people’s court in the location of the Platform’s operating entity for litigation.
9.3 These Terms form an integral part of the relevant agreements of the Platform. Matters not covered herein shall be subject to the relevant rules publicly announced by the Platform.
